2020 COVID Rule Changes

SECTION A: 2020 COVID-19 RULE CHANGES

A.1 General

A State of Emergency has been proclaimed in 2020 pursuant to Executive Order N33-20 regarding COVID-19.

  • These rules are intended to change, modify, supplement, and limit pre-existing rules the Association had adopted prior to the COVID-19 pandemic until these rules are later modified by the Association, or expire as set forth herein. Where there is a conflict between the pre-existing rules and these 2020 COVID-19 rules, the 2020 COVID-19 rules control in all respects.

A.2 Pool Rules

  • Residents must agree to NOT swim if they have any symptoms or exposure risks as listed by the CDC Guidelines.
  • Individuals visiting the pool complex must comply with social distancing as mandated by the State of California and Orange County Department of Public Health.
  • All swimmers must be Emerald Bay residents and must agree to NOT congregate around the pool complex. Guests are permitted providing they are accompanied by their resident host.
  • The Pool Complex is open for swim seven (7) days a week, from 6:00 a.m. to 6:00 p.m. by appointment only; 6:00 a.m. to 11:00 a.m. is reserved for lap swim only.
  • Appointments can be made online any time at http://ebrecreation.com/covid-19-poolaccess/ or by calling 949-376-8232 between the hours of 9:00 a.m. and 10:00 a.m., Monday through Friday. Cancellations can be made by emailing bhodges@ebca.net or by calling 949-376-8232. Calls and voicemails received outside of these hours will not be accepted and are not a valid form of registration.
  • Appointments are on a limited use basis to support social distancing measures.
  • Appointments are restricted to 45-minute time slots to allow a 15-minute window for cleaning before the next session begins. If you arrive later than your scheduled start-time, you are still required to vacate the pool by your scheduled end-time.
  • Appointments are restricted to one appointment per Resident per day, as availability allows.
  • Once an appointment has been booked, an email will be sent with confirmation. Only those with confirmations will be admitted into the complex. Those without appointments may be admitted to the complex on a first come, first served basis, if there is available capacity as determined by the lifeguard on duty.
  • Individuals with confirmed appointments must be present five minutes before and practice social distancing while queuing to be allowed into the complex.
  • Booking privileges will be revoked from any individual who fails to show up to their appointment without prior notification or fails to comply with the pool complex rules. Nuisance citations, which carry a fine of up to $5,000 if levied, may also apply.
  • These pool rules will remain in effect until January 1, 2021 at which time the Association will revert back to, and enforce, the relevant pre-COVID pool rules.

A.3. Private events

  • All reservation requests for private events in the common areas or common area facilities must be received no fewer than seven (7) days prior to the proposed event and will be evaluated, and approved or disapproved on a case-by-case basis by Association Staff or the Board, depending on the nature of the event. A decision will be based on then-current State and County orders and guidance regarding maximum group size, plans for maintaining physical distancing between attendees, and other considerations such as catering options using disposable food service items, pre-packaged boxes or bags for each attendee instead of buffet or family-style meals and plans for physical distancing.
