Dear Neighbors, I am pleased to let you know that the temporary volleyball rules, which the Board enacted prior to limiting beach access, have now been reinstated. Residents are free to play volleyball as of today, in teams of no more than four players or a family unit. Special thanks go out to Gary Cogorno for his expertise and willingness in taking down, putting up, taking down, and putting up once again, the volleyball nets! Thank you, Gary! Beach use is for active use only, no lounging or gatherings at this time. I urge you to respect these rules and avoid gathering at the volleyball courts (or elsewhere on the beach) as I know for sure that Gary does not want to be in the position of having to take the nets down once again! The responsibility is in your hands. As we await the arrival of our beach wristbands, we continue to make plans for their implementation. Dear Emerald Bay Residents, The Association has amended it’s temporary rules regarding Tennis reservations. Effective immediately, the Association will begin accepting reservations. The earliest the first reservation can be made is for Saturday, May 16, 2020. There will be no exceptions to this reservation timeline. The following outlines the updated temporary rules for making court reservations: Reservations may be made for play during hours of 7:30 a.m. to 12:00 p.m. Reservations must be made using the following procedures: Requests must be sent via email to tennis@ebca.net. Phone reservations will not be accepted. Reservation requests must include your: Full name and Emerald Bay address Preferred date and start time Preferred court # Type of play: singles or doubles Reservations are not valid until a confirmation email is received. Reservations may be requested no earlier than seven days in advance. Reservation requests must be submitted by 12:00 p.m. the day prior. Same-day reservations will not be accepted. Weekend reservation requests must be submitted by 12:00 p.m. on Friday. Reservations will be posted daily on the tennis bulletin board adjacent to Court 1 and online at www.ebrecreation.com. A copy of the amended Tennis Rules can be found HERE. The amended rules will also be posted at all Tennis courts. Dear Emerald Bay Residents, At their regularly scheduled meeting on Tuesday, May 5, 2020, the Association’s Board of Directors examined its current restrictions related to COVID-19. After extensive discussion and input from the Membership, the Board voted to further ease some of the restrictions in place on the Association’s pool, tennis courts, and playgrounds. The pool complex is now open for swim seven (7) days a week, from 6:00 a.m. to 6:00 p.m., by appointment only; with the hours of 6:00 a.m. to 11:00 a.m. reserved for lap swim only. The baby pool and jacuzzi are now available, also by appointment only, for individual or single-family use during each appointment time. More lap swim appointments have also been made available. The temporary tennis rules have been modified to allow doubles, “whisper ball,” and all temporary time restrictions have been lifted. Emerald Bay’s playgrounds are now open for use at everyone’s own risk. Please note that, due to limited resources, the Association is unable to sanitize the playground equipment after each use. Each family using the playground must bring their own hand sanitizer or sanitizing wipes and all users should sanitize their hands before and after use of the playground equipment. Car washers are allowed access to the Bay providing that all services are conducted on, or directly in front of, the Member’s property. Beach restrictions temporarily enacted limiting use to residents and for walking or passive exercise only, while maintaining social distance from other residents, remain in force until further notice. However, while these temporary beach restrictions are in place, the Board voted to temporarily remove dog hours restrictions so that dogs can accompany residents walking on the beach throughout the day. The Board and staff are sensitive to the resulting hardship caused by these restrictions and will continue to evaluate these restrictions daily based on the most up-to-date guidance. It is important to remember that Orange County beach activity is still being scrutinized, including the use of Emerald Bay beach. Please continue to act responsibly. Emerald Bay Community Association NOTICE OF UPDATED EMERGENCY RULES ENACTED DUE TO COVID-19 Given the Board’s determination that immediate rule changes were required to address imminent threats to the public health or safety of the Association’s members, per Civil Code §4360(a) and (d), the following emergency rule changes have been made in order to comply with Governor Gavin Newsom’s Executive Order N-33-20 issued on March 19, 2020. The effect of each rule change is to ensure that the Association’s employees and Members mitigate the impact of COVID-19, bend the curve and disrupt the spread of the virus. Cancellation of all scheduled private events in the common areas & a temporary moratorium placed on future common area reservations. Cancellation of all scheduled community events and classes. Summer Camp may proceed based on size restrictions at the time. Closure of the Community Center/Office, Firehouse, and Volleyball Courts. Tennis courts are limited to no more than four (4) players on each court at any given time or a family unit (A full list of the temporary tennis rules, previously noticed and updated, can be found at ebrecreation.com) The pool complex is open for swim seven (7) days a week, from 6:00 a.m. to 6:00 p.m. by appointment only; 6:00 a.m. to 11:00 a.m. is reserved for lap swim only. All Members recreating in the Association’s open facilities are to practice social distancing at all times. Nuisance Citations will be issued to any Members who are not adhering to these rules and who are observed obviously increasing risk to the public health of others by not practicing safe social distancing. The above-rule changes will stay in effect until further notice, but no longer than 120 days when adopted. TEMPORARY EBCA TENNIS RULES (Adopted by the Board of Directors on April 28, 2020 & Amended on May 5, 2020) All players must agree to NOT play if they have any symptoms or exposure risks as listed by the CDC Guidelines. All players must agree to practice social distancing at all times by standing at least 6 feet apart. All players must agree to NOT congregate around the courts. The tennis courts are open for play seven (7) days a week, from 6:00 a.m. to 10:00 p.m. on a first-come-first-served basis. Each court is limited to no more than four (4) players on each court at any given time or a family unit. Court use is restricted to one-hour use. Players must use their own balls. The USTA recommends utilizing two different cans of tennis balls, with one player utilizing one set of numbered balls and the other player utilizing the other set of differently numbered balls and discarding them after use. Use your racquet/foot to pick up balls and hit them to your opponent. Players must provide their own drinking water (do not share water). All water will be shut-off. Please consider bringing your own hand sanitizer and using after touching any surfaces in the court areas. All common use equipment (ball machine, ball collector, balls) have been temporarily removed from the court area. This is being done in order to reduce the risk of spreading the COVID-19 virus. Leave the tennis court doors ajar to avoid the need for touch. Players that do not adhere to these rules may lose their court privileges. Dear Neighbors, I am requesting all of the Association’s help and calling for your individual accountability. Having listened to Governor Newsom’s press conference, including his restrictions to Orange County’s public beaches, it is imperative that the Association’s Membership heed his warnings and act responsibly for the health, safety, and wellbeing of everyone. On behalf of the Association and its Board, I am restricting use of the Association’s beach, effective immediately, to residents only until further notice. Further, use of the beach will be restricted to walking or other passive exercise that can be performed while maintaining social distance from other residents. No gatherings, lounging or volleyball will be allowed on the beach until these restrictions can be lifted. I recognize the inconvenience this may cause everyone, and I apologize in advance; however, it seems the prudent action to take with the present information available to the Association. The Association will have extra security on hand starting tomorrow to remind residents of the need to remain socially distant from each other and monitor activities on the beach. In the event residents break these rules, nuisance citations will be issued with possible fine amounts of up to $5,000.00. Please help the Association avoid the need to issue citations by acting responsibly. Rest assured that all Orange County beach activities will be scrutinized in the coming days and weeks until the restrictions are lifted. This includes the Emerald Bay beach. Dear Emerald Bay Residents, The Board held a Special Board Meeting today to discuss the Association’s response to COVID-19 and to consider easing the restrictions of the Emergency Rules previously adopted concerning Emerald Bay’s outdoor facilities in conjunction with increased monitoring of the Members use of those facilities. After extensive discussion and input from the Membership, the Board voted to ease the restrictions on use of the Association’s pool, tennis courts, volleyball courts, and basketball court while adopting temporary restrictions on how those facilities can be used beginning tomorrow, Wednesday, April 29, 2020, including reduced hours of operation. The Board voted to temporarily restrict guest access to the Association’s outdoor facilities from Saturday, May 2 through Sunday, May 3, 2020. The Board also modified the previously enacted rule regarding car washers. Car washers will be allowed access to the Bay as of Wednesday, April 29, 2020 providing that all services are conducted on a Member’s property. No services can take place on the Association’s streets. These Temporary Rules and all other Emergency Rules previously enacted by the Board remain in effect until further notice, with the Emergency Rules remaining in effect no longer than 120 days from March 19, 2020, i.e. July 17, 2020. Nuisance citations, which carry a fine of up to $5,000 if levied, will be issued to any Members who are not adhering to these rules. Dear Emerald Bay Residents, Governor Gavin Newsom issued direction to all California residents on March 19 to stay at home effective immediately unless they are participating in essential functions like purchasing food, caring for a relative or friend, getting necessary health care, or going to an essential job. Vulnerable populations and residents age 65 and older are advised to stay at home. The Order, issued by the California State Public Health Officer and Director of the California Department of Public Health is intended to slow the spread of COVID-19 to California citizens. According to the Order, when people need to leave their homes or places of residence for essential functions, they should constantly practice social distancing (maintaining a six-foot separation from all persons except family members). The Association remains committed to protecting the health and well-being of everyone in the Emerald Bay community. As such, we are exercising caution and taking the measures as outlined by The California Department of Public Health, and summarized below, to help prevent the contraction and spread of COVID-19. Community Events • All Community Events, including tennis and fitness classes, and private events in the common areas are cancelled until further notice. Common Areas • The Community Center/Association Office, Firehouse, Pool, Tennis Courts, Volleyball Courts, Basketball Court, and Playgrounds are temporarily closed until further notice. • While the beach and parks remain open, the California State Public Health Officer and Director of the California Department of Public Health is ordering all individuals living in the State of California to stay home or at their place of residence and if you go out, to practice social distancing by keeping at least 6 feet of distance. Please bear this in mind when exercising on the beach. • Please avoid putting a strain on our beach and compromising the health of our residents by inviting outside guests into Emerald Bay. Member Events • The Board has placed a temporary moratorium on future event reservations. • This is an emergency rule and will stay in effect until further notice, but no longer than 120 days from March 19, 2020, i.e., July 17, 2020. However, the Board may reinstate it afterwards depending on what the circumstances are at that time.
